Vikings Reach NFL Playoffs: Adrian Peterson Powers Minnesota Past Packers

MINNEAPOLIS ? Adrian Peterson picked up the Minnesota Vikings and gave them a thrilling ride to the playoffs, where the next stop on this improbable journey is, yes, Green Bay.

This game was so full of action, intrigue and tension they're going to stage it again next weekend.

Peterson finished 9 yards shy of breaking Eric Dickerson's single-season rushing record, but he still powered the Vikings past the Packers 37-34 Sunday with 199 yards to set up a rematch at Lambeau Field in a first-round playoff game.

"I told myself to come into this game focused on one thing, and that's winning," Peterson said.

Peterson rumbled around the left side of the line for a 27-yard gain in the closing seconds, his career-high 34th carry exactly one year after reconstructive surgery on his left knee. That set up Blair Walsh's 29-yard field goal as time expired and put the Vikings (10-6) in the postseason after consecutive last-place finishes.

"For our guys to be as resilient as they were, it has you swelling with pride," coach Leslie Frazier said.

The division champion Packers (11-5) dropped to the NFC's No. 3 seed. Their five-game winning streak against the Vikings ended.

"I had a feeling that we had the game in the bag the whole game," Vikings cornerback Chris Cook said. "It was just a vibe that I had on the sideline, in how we were carrying ourselves."

Aaron Rodgers completed 28 of 40 passes for 365 yards and four touchdowns and no interceptions, connecting with Jordy Nelson from 2 yards to tie the game with 2:54 remaining. But Christian Ponder threw for three scores, including one to Peterson.

Ponder went 16 for 28 for 234 yards, including a 65-yard zinger in stride to Jarius Wright midway through the fourth quarter that set up Ponder's third touchdown toss.

"It's disappointing. A lot of us wanted that extra week," Rodgers said.

Peterson finished with 2,097 yards, becoming the seventh player in NFL history to reach the 2,000 mark. He had to work for it, pulling out all the cutbacks, stutter-steps and spins he could find in his exceptional skill set. His longest run was only 28 yards against a defense geared to slow him down, and the first contact often came at, near or behind the line of scrimmage.

"It wasn't meant to happen, or it would've happened. Not to say it doesn't hurt, because it does," Peterson said of Dickerson's 28-year-old record. "But we came in here tonight and accomplished the ultimate goal, and that was getting a win and punching our ticket to the playoffs."

The Packers cut the lead to 27-24 late in the third quarter on a touchdown reception by James Jones. The on-field ruling was a fumble at the goal line, triggering an automatic review. Because the Packers threw the challenge flag after the replay process began, however, they were only penalized for unsportsmanlike conduct, not prevented from benefiting from the overturned call. That's what happened to Detroit infamously on Thanksgiving, when a disputed score by Houston was prevented from review.

After posting a 9-23 record over the last two years, the Vikings made so many strides in 2012 that the season was already a success. But no NFL team would ever be satisfied by finishing in defeat against a division rival, and the emotion and energy behind the quest was palpable all afternoon.

"It took us a little while to adjust to the crowd noise, and we didn't get going," Packers coach Mike McCarthy said. "That usually happens up here. This is a tough place to play, no doubt. We anticipated this being the loudest environment of the year. They pumped it in here pretty good today."

The NFC North was sewn up by the Packers two weeks earlier. Even though the bye remained in the balance the top seed didn't do the Packers any good last season. They went 15-1 and lost their opener at home to the eventual champion Giants.

Rodgers played without injured leading receiver Randall Cobb, so Greg Jennings was the main guy, grabbing eight passes for 120 yards and two touchdowns. But the Vikings sacked Rodgers five times, recovering a fumble on one of them at midfield to set up a third-quarter touchdown.

Rodgers has 24 touchdowns, only four interceptions and a 70 percent completion rate over 10 career starts against the Vikings. His poise, arm strength and savvy came through clear against them as much as any other team. Plus, cornerback Antoine Winfield's aggravated hand injury kept him on the sideline for most of the game.

Just as Ponder capably complemented Peterson, DuJuan Harris came out of nowhere to provide Rodgers some help. Green Bay has been proving lately it's not a one-sided offense, either, and Harris rushed 14 times for 70 yards

But this was Peterson's show. Second-and-27? He surged off right tackle and bounced outside for 28 yards on a drive that ended with his second touchdown, a 2-yard reception that pushed the lead to 27-17 in the third quarter. The "MVP" chants from the crowd rang out in earnest after that.

NOTES: Cobb's absence meant the Packers went without a 1,000-yard receiver for the first time since 2003. Cobb finished with 954 yards. ... Vikings WR Jerome Simpson was woozy after an end-zone collision in the third quarter, falling back down after trying to get up the first time. He passed concussion tests and returned to the game.

Is Washington Redskins Backup QB Kirk Cousins game for a trade if it meant he would be a starting quarterback?

Stung Bankia investors look to courts for justice

MADRID (Reuters) - Spanish savers and pensioners who have seen their money wiped out by investing in state-rescued lender Bankia are likely to seek redress in court rather than wait for any official inquiry, which looks increasingly unlikely.

About 350,000 stockholders will share the pain of the bank's European bailout, many of them bank clients who were sold the shares through an aggressive marketing campaign for its stock market flotation in 2011.

Shares in the lender, rescued by the state in May in Spain's biggest ever bank bailout, fell to record lows on Friday, tumbling over 40 percent from the start of the week after it emerged losses on bad loans were worse than expected.

"Going to the courts and seeing if a judge can bring us justice is the only path left to us," said Maricarmen Olivares, whose parents lost 600,000 euros ($793,300) they made from selling her father's car workshop by investing in Bankia preference shares.

Neither of the two main political parties want to push for a full investigation into Bankia's demise, which could draw attention to their own role in a debacle that has driven Spain to the brink of an international rescue, commentators say.

"Investigations work when a political party has something to gain over another. In this case, no-one has anything to gain," said Juan Carlos Rodriguez, of consultancy Analistas Socio Politicos.

"I don't see the big parties investigating this because if there have been errors committed, they have been committed by both sides."

The Socialist Party was in power when Bankia was formed in 2010 from an ill-matched combination of seven regional savings banks, a union that concentrated an unsustainable exposure to Spain's collapsed property sector.

Immense political pressure from the then government forced Bankia executives to push ahead with an initial public offering in July 2011 as Spain sought to bring private capital into its banking system and avoid a European bailout.

Then chairman, Rodrigo Rato, a former chief of the International Monetary Fund, had strong links to the centre-right Popular Party (PP) and was finance minister in a previous PP administration.

A small political party, UPyD, forced the High Court in July to open an investigation into whether Rato, ousted when the bank was nationalized in May, and 32 other former board members are guilty of fraud, price-fixing or falsifying accounts.

Investigating magistrate Fernando Andreu has so far not brought charges against anyone and could still drop the case.

"WE WON'T SEE OUR MONEY AGAIN"

Rato appeared in a private session before the judge on December 20 where he denied any blame for what happened.

Rato, who cannot legally speak to the press because he is the subject of a court investigation, has kept a low profile since the bank rescue in May. Protesters gathered outside the court on the day of his declaration wearing masks of his face.

The probe centres around Bankia's stock market listing, the formation of the lender from the seven savings banks and the gaping capital shortfall revealed at the bank after the state takeover in May.

Rato and 23 others including bank executives and cabinet ministers were called to testify before a parliamentary committee in July this year where Rato said he had a clear conscience and had done things properly.

"That was just window-dressing by the PP following the outcry over the Bankia disaster," said a Socialist Party source.

The opposition Socialists called for a full parliamentary investigation in May, but the ruling PP blocked it, the Socialist Party source said. A PP spokeswoman said any investigation of Bankia should be carried out through the courts, not the government.

A government source said any investigative process would not fall to the government, but to the courts.

Bankia, alongside other Spanish banks, sold billions of euros of preference shares and subordinated debt to high street clients, many of whom say they were tricked into parting with their savings and are seeking compensation.

The investigating magistrate is not including the mis-selling of preference shares - hybrid instruments that fall between a share and a bond - in the probe.

Holders of preference shares at Bankia will incur losses of up to 46 percent as part of the European bailout, receiving shares rather than cash in exchange.

"We won't see our money again, that's for sure. They'll give us shares, but shares with no value or credibility in a nationalized bank," said Olivares, who said she had heard nothing from the bank as to how much their losses would be.

The losses each investor will have to take has yet to be decided, a Bankia spokesman said, adding that hybrid debtholders at all rescued banks had to take losses, not just at Bankia.

A source close to the court investigation said there would certainly be scope for a separate wider probe into the mis-selling of preference shares, not just at Bankia, but throughout Spain's savings banks.

Olivares, like many other small savers at Spain's state-rescued banks, claims her parents were sold the preference shares as a kind of high-interest savings account and that the bank staff did not explain the risks attached.

The government is in the process of setting up an arbitration process to compensate Bankia clients who can prove that they were duped into buying preference shares, Economy Minister Luis de Guindos said last week.

But many ordinary Spaniards who lost their life savings through the Bankia rescue say this is not enough and they want answers as to what happened to their money.

"We want justice, at least some kind of recognition that we were swindled," said Raimundo Guillen, a 50-year-old electricity station worker who put 30,000 euros in preference shares with Bankia under the impression they were a form of savings account.

"It's as if they've stolen your wallet - blatantly, with their face uncovered."

UPDATE: (6:07 p.m.) The NFL has announced the 49ers will host their divisional round playoff game on Saturday, Jan. 12 at 5:00 PST. Their opponent is yet to be determined.

SAN FRANCISCO -- Candlestick Park disgorged its human contents slowly, which is the only way it ever does. Alex Smith had almost surely closed out his 49ers career with a kneel-down, David Akers remained a conundrum wrapped in an enigma encased in a kicking shoe, Justin Smith?s triceps tendon had not yet healed itself, and Jim Harbaugh was, well, Jim Harbaugh.

Meanwhile, the Green Bay Packers flailed impotently against the tide that is Adrian Peterson, and here we must credit the 100 or so fans who stayed in the stadium to watch the scoreboard as it showed Blair Walsh?s game-winning field goal. The Vikings won 37-34, the 49ers got this weekend off, and host someone next week. They were thrilled with this development, as the locker room roar showed.

And yet the bye is a gift that is delivered with a mailed fist.

The 49ers need the week in hopes that J. Smith (as opposed to A.D. Smith) can make himself fully functional. And that Colin Kaepernick can advance his learning curve. And that David Akers can find the left foot he apparently left behind at the end of last season. Plus, who doesn?t want a break from running into other people repeatedly at great rates of speed?

On the other hand, teams with the bye win almost 54 percent of the time, making the 49ers a coin flip in the divisional round. An 11-4-1 coin flip.

And a coin flip with as many questions as answers. A coin flip without momentum, and as we surely know, December momentum more than any other commodity is what gets teams to the Super Bowl.

The 49ers didn?t get a lot of impetus from beating Arizona, 27-13. The Cardinals are awful as usual, one of the game?s enduring Jell-O punching bags. You hit it repeatedly, you feel good hitting it, but in the end it hasn?t given you the kind of test you need for the next steps.

But other than Michael Crabtree, who made a mockery of whatever passes for the Arizona secondary, no 49er offensive player excelled, and the defense was never challenged by a Cardinal team with no weapons whatsoever. It was a desultory performance made even less settling by Akers? latest field goal misses, giving the 49ers the most worrisome kicking of the postseason combatants.

Indeed, of the teams already in, only Green Bay (Mason Crosby) has a poorer percentage of field goal conversion, but they made up for it by scoring more TDs than any other NFC team. And Crosby is only bad beyond 50 yards, whereas Akers? issues are from 40 out.

In short, unless the 49ers want to concoct an injury to Akers out of his collision with Arizona?s Justin Bethel, they already have a disadvantage to go along with Smith?s questionable status, and the fact that they have only one go-to receiver, Crabtree.

They are not going into this postseason with the same gleeful trouble-free stride with which they entered last year?s playoffs. momentum, remember?

Not only that, the two NFC teams with the bye, San Francisco and Atlanta, are the only ones with two losses in December. Seattle (No. 5) went unbeaten, Minnesota (No. 6) won its last four after losing at Green Bay in Week 12, and Green Bay (No. 3) had won four straight before losing Sunday.

None of this makes them unqualified for Super Bowl status, mind you. In this field, there is no team that doesn?t have that quality to them, because everyone either backed into the postseason or rallied frantically to get there.

But these are not the 49ers of yore, as in last year. Things are coming harder, and the margin for error creates a tighter squeeze. Without Smith, that margin becomes almost prosciutto-thin.

So yes, Blair Walsh did the 49ers a great service on Sunday, and so did Adrian Peterson. But the real truth is that the 49ers are going to have a harder time making an impression this time than they did a year ago, and the key is, as ever, Justin Smith. With him, they are in play. Without him, who knows?

But this much is sure. Last year, the 49ers were playing with the casino?s money all year long. This year is going to be a pure white-knuckler ? starting now.

Apple drops patent claim against Samsung Galaxy S3 Mini

The Samsung Galaxy S3 Mini will not be involved in the next round of the never-ending Apple vs Samsung patent war.

The little brother of the flagship Galaxy S3 had been named alongside a host of Samsung devices which, according to Cupertino, infringe Apple's intellectual property.

The warring companies had been asked to present their lists of disputed devices as they gear up for a second trial in California, scheduled to begin in March 2014.

As the Galaxy S3 Mini is not being sold in the United States, Apple has sportingly agreed to strike it from the list.

Round two

However, it's not as if Samsung will be doing cartwheels about the news. Apple's list still includes the Galaxy S3, Galaxy Note 2, Galaxy Tab 8.9, Galaxy Tab 2 10.1 and Rugby Pro devices.

Apple also reserves the right to reinsert the S3 Mini if Samsung decides to launch it Stateside.

The second trial, which follows Apple's crushing victory this summer, will also hear Samsung's claims about the iPhone 5.

Lawyer for Newtown survivor seeks to file $100 million lawsuit

MERIDEN, Connecticut -- A $100 million claim on behalf of a 6-year-old survivor is the first legal action to come out of the Connecticut school shooting that left 26 children and adults dead two weeks ago.?

The unidentified client, referred to as Jill Doe, heard "cursing, screaming, and shooting" over the school intercom when the gunman, 20-year-old Adam Lanza, opened fire, according to the claim filed by New Haven-based attorney Irv Pinsky.

"As a consequence, the ... child has sustained emotional and psychological trauma and injury, the nature and extent of which are yet to be determined," the claim said.


Pinsky said he filed a claim on Thursday with state Claims Commissioner J. Paul Vance Jr., whose office must give permission before a lawsuit can be filed against the state.

"We all know its going to happen again," Pinsky said on Friday. "Society has to take action."

Twenty children and six adults were shot dead on Dec. 14 at the Sandy Hook Elementary School in Newtown, Conn. The children were all 6 and 7 years old.

Pinsky's claim said that the state Board of Education, Department of Education and Education Commissioner had failed to take appropriate steps to protect children from "foreseeable harm."

It said they had failed to provide a "safe school setting" or design "an effective student safety emergency response plan and protocol."

Pinsky said he was approached by the child's parents within a week of the shooting.

The shooting, which also left the gunman dead, has prompted extensive debate about gun control and the suggestion by the National Rifle Association that schools be patrolled by armed guards. Police have said the gunman killed his mother at their home in Newtown before going to the school.?

POLICE ROUNDUP: London man struck by baseball bat

LAUREL COUNTY ? A London man who awakened to find personal belongings missing ended up getting struck in the head with a baseball bat, according to Laurel County Sheriff John Root.

Root said Deputy Robbie Grimes continues his investigation into the assault which happened Wednesday at Sweet Hollow Apartments south of London.

Jeffery Dale Robbins, 50, was transported to Baptist Regional Medical Center by Ambulance Inc. of Laurel County.

He told deputies he was asleep, and when he woke up some of his things were missing.

He lives with his sister and brother-in-law, who were in the home at the time the items were reported missing.

According to Root, an argument ensued over the missing items, and as Robbins was attempting to leave, he was struck over the head with the bat.

The investigation continues.

Out-of-control juvenile in custody

A 16-year-old reported to be ?out of control? was taken into custody by a court-designated worker Wednesday.

Laurel County Sheriff John Root said Deputy Robbie Grimes and Senior Sgt. Greg Poynter took the male juvenile into custody at 10:19 p.m. after being dispatched to a complaint of an out-of-control juvenile on Oneal Road, west of London.

Upon arrival Grimes and Poynter learned the juvenile became angry and pulled a knife on a resident at the home. He also allegedly threatened to kill persons in the home as they slept. The argument was reportedly over a marijuana plant found in the juveniles? room, which an adult resident of the house found and flushed down the toilet.

(AP) ? Senate leaders rushed to assemble a last-ditch agreement to avoid middle-class tax increases and possibly delay steep spending cuts in an urgent attempt to find common ground after weeks of postelection gridlock.

An impatient President Barack Obama pressed top lawmakers to cut a deal, even one that falls short of the ambitions he and congressional leaders may once have harbored for a bigger deficit reduction package. Without a resolution, he warned, "every American's paycheck will get a lot smaller."

"Congress can prevent it from happening, if they act now," he said in his weekly Saturday radio and internet address.

Following a White House meeting Friday among Obama and congressional leaders, aides to Senate Republican leader Mitch McConnell of Kentucky and Senate Majority Leader Harry Reid, D-Nev., began racing against the clock for a bipartisan bargain. The leaders could present legislation to senators as early as Sunday, with a vote possible on Sunday or Monday.

The guest list for the White House meeting included Reid, McConnell, House Speaker John Boehner, R-Ohio, and House Democratic leader Nancy Pelosi, D-Calif. But the key players were clearly Reid and McConnell, both of whom stayed behind briefly at the White House and huddled with their staffs and Obama's top legislative aide, Rob Nabors, in the West Wing Cabinet Room just outside the Oval Office.

Neither side expected compromise to be easy. However, McConnell and Reid voiced unexpected optimism that they could work toward a deal that could win support in both their camps.

Warned Reid: "Whatever we come up with is going to be imperfect."

Looking to add pressure on negotiators, Obama said that absent a compromise he expects Reid to put legislation on the floor to prevent tax increases on the middle class and extend unemployment benefits ? an implicit challenge to Republicans to dare to vote against what polls show is popular.

Speaking for Republicans in a Saturday radio address, Sen. Roy Blunt of Missouri sought to put the burden of a deal on Obama and Reid.

"We still can avoid going over the fiscal cliff if the president and the Democrat-controlled Senate step forward this week and work with Republicans to solve this problem and solve it now," he said.

Whatever manages to pass in the Senate, with its Democratic majority, would then face a second test in the Republican-controlled House.

Boehner, a Republican speaker who has struggled recently with anti-tax rebels inside his own party, said through an aide that he would await the results of the talks between the Senate and White House. A House vote could come as late as Wednesday, the final full day before a new Congress takes office.

Officials said there was a general understanding that any agreement would block scheduled income tax increases for middle-class earners while letting rates rise at upper-income levels.

Obama was sticking to his campaign call for increases above $250,000 in annual income, even though in recent negotiations he said he could accept $400,000.

The two sides also confronted a divide over estate taxes. Obama favors a higher tax than is currently in effect, but one senior Republican, Sen. Jon Kyl of Arizona, said he's "totally dead set" against it. Speaking of fellow GOP lawmakers, he said they harbor more opposition to an increase in the estate tax than to letting taxes on income and investments rise at upper levels.

But the estate tax was more likely to be used as a possible bargaining chip that Democrats could give away in exchange for higher rates for top earners and other Obama priorities.

Obama and Democrats want to prevent the expiration of unemployment benefits for about 2 million long-term jobless men and women, and there is widespread sentiment in both parties to shelter doctors from a 27 percent cut in Medicare fees.

Also likely to be included in the negotiations are taxes on dividends and capital gains, both of which are scheduled to rise with the new year. Also the alternative minimum tax, which, if left unchanged, could hit an estimated 28 million households for the first time and mean an average increase of more than $3,000.

The White House has shown increased concern about a possible doubling of milk prices if a farm bill is not passed in the next few days, although it is not clear whether that issue too might be included in the talks.

One Republican who was briefed on the White House meeting said Boehner made it clear he would leave in place spending cuts scheduled to take effect unless alternative savings were included in any compromise to offset them. In previous White House proposals, Obama has suggested finding enough cuts in government spending to put off the steeper cuts for up to six months.

Obama, speaking to reporters following his meeting with the congressional leaders, faulted a system that left crucial decisions to the last minute, a way of governing that he said the public finds "mindboggling."

"Outside of Washington nobody understands how it is that this seems to be a repeat pattern, over and over again," he said.

Still, Obama himself is part of the negotiating process, and his meeting with all four top leaders Friday was the first since Nov. 16. A phone call he placed Wednesday night to McConnell was the first the Republican leader had received from a Democrat on the fiscal talks since Thanksgiving.

Looking to add pressure on negotiators, Obama said he expects Reid to put legislation on the floor to prevent tax increases on the middle class and extend unemployment benefits ? an implicit challenge to Republicans to dare to vote against what polls show is popular.

The start of negotiations in the Senate marked a new endgame for discussions that have moved in fits and starts since the November election.

Boehner refused for weeks to accept any rate increases, and simultaneously accused Obama of skimping on the spending cuts he would support as part of a balanced deal to reduce deficits, remove the threat of spending cuts and prevent the across-the-board tax cuts.

Last week, the Ohio Republican presented a Plan B measure that would have let rates rise on million-dollar earners, well above Obama's latest offer for a $400,000 threshold.

Facing defeat, Boehner scrapped plans for a vote, leaving the economy on track for the cliff that political leaders in both parties had said they could avoid.

Woman charged in connection with fatal NY firefighter shootings

Authorities announce a second person has been arrested and charged in connection with the shooting deaths of two firefighters in Webster, NY.

Updated: 4:58 p.m. ET: An upstate New York woman was arrested Friday and hit with?federal and state charges connected to the fatal shootings of two volunteer firefighters on Christmas Eve.

The woman, Dawn Nguyen, 24, was charged with knowingly making a false statement in the purchase of guns used in the slayings,?U.S. Attorney William Hochul told a news conference Friday. She was charged earlier on a state violation of filing a falsified business record.


Hochul said Nguyen bought the guns on behalf of William Spengler, 62,?who shot four firefighters responding to a fire he had started in his home on Monday outside Rochester, N.Y., killing two of them, before killing himself.

Nguyen "told the seller of these guns, Gander Mountain in Henrietta, that she was to be the true owner and buyer of the guns instead of William Spengler," he said. "It is absolutely against federal law to provide any materially false information related to the acquisition of firearms."

The complaint alleges that Nguyen acted as a "straw purchaser" for Spengler, who, as a convicted felon, could not legally own, acquire or purchase any firearm, Hochul said. The charges are related to an AR-15-type semiautomatic rifle and a 12-gauge shotgun ? two of the three weapons found near Spengler's body Monday, according to State Police Investigator James Sewell.

Hochul said that a suicide note left by Spengler "includes information about obtaining the guns" from Nguyen.

The third weapon, a .38-caliber revolver, was not connected to Nguyen, Sewell said.

William Spengler, in a 2006 photo, who authorities say set a house and car on fire on Christmas eve in Webster, N.Y. and then shot and killed two firefighters, and wounded two others who responded to the blaze.

The Rochester Democrat and Chronicle reported that Nguyen was arrested Friday afternoon at the home in Greece where she has been staying with her mother, Dawn Welsher.

Greece is about 5 miles north of Rochester and 2 miles west of Webster, where Spengler lived.

Nguyen's lawyer, Dave Palmiere, told the newspaper that Nguyen bought the weapons legally and that they had been stolen. He said Nguyen didn't recall whether she reported the guns stolen.

Welsher told the Democrat and Chronicle that neither she nor her daughter, Nguyen, gave or sold Spengler the weapons.?

"This is nuts," she said, according to the newspaper. "I never supplied this man with nothing. My daughter never supplied him with anything. He's setting us up."

The federal charge carries a maximum penalty of ten years in prison a $250,000 or both, The Associated Press reported.

Spengler spent 17 years in prison for killing his grandmother in 1980.

After Monday's attack, a body was also discovered in Spengler's burned home.?Investigators?have said they believe the remains are those of his sister, Cheryl Spengler, 67, who lived with him. In all, seven houses were destroyed in the blaze.

Budget battle sends mixed signals on health care

(AP) ? Confused about the federal budget struggle? So are doctors, hospital administrators and other medical professionals who serve the 100 million Americans covered by Medicare and Medicaid.

Rarely has the government sent so many conflicting signals in so short a time about the bottom line for the health care industry.

Cuts are coming, says Washington, and some could be really big. Yet more government spending is also being promised as President Barack Obama's health care overhaul advances and millions of uninsured people move closer to getting government-subsidized coverage.

"Imagine a person being told they are going to get a raise, but their taxes are also going to go up and they are going to be paying more for gas," said Thornton Kirby, president of the South Carolina Hospital Association. "They don't know if they are going to be taking home more or less. That's the uncertainty when there are so many variables in play."

Real money is at stake for big hospitals and small medical practices alike. Government at all levels pays nearly half the nation's health care tab, with federal funds accounting for most of that.

It's widely assumed that a budget deal will mean cuts for Medicare service providers. But which ones? How much? And will Medicaid and subsidies to help people get coverage under the health care law also be cut?

As House Speaker John Boehner famously said: "God only knows." The Ohio Republican was referring to the overall chances of getting a budget deal, but the same can be said of how health care ? one-sixth of the economy ? will fare.

"There is no political consensus to do anything significant," said Dan Mendelson, president of Avalere Health, a market analysis firm. "There is a collective walking away from things that matter. All the stuff on the lists of options becomes impossible, because there is no give-and-take."

As if things weren't complicated enough, doctors keep facing their own recurring fiscal cliff, separate from the bigger budget battle but embroiled in it nonetheless.

Come Jan. 1, doctors and certain other medical professionals face a 26.5 percent cut in their Medicare payments, the consequence of a 1990s deficit-reduction law gone awry. Lawmakers failed to repeal or replace that law even after it became obvious that it wasn't working. Instead, Congress usually passes a "doc fix" each year to waive the cuts.

This year, the fix got hung up in larger budget politics. Although a reprieve is expected sooner or later, doctors don't like being told to sit in the congressional waiting room.

"It seems like there is a presumption that physicians and patients can basically tolerate this kind of uncertainty while the Congress goes through whatever political machinations they are going through," said Dr. Jeremy Lazarus, president of the American Medical Association. "Our concern is that physician uncertainty and anxiety about being able to pay the bills will have an impact on taking care of patients."

A recent government survey indicates that Medicare beneficiaries are having more problems when trying to find a new primary care doctor, and Lazarus said that will only get worse.

Adding to their unease, doctors also face an additional reduction if automatic spending cuts go through. Those would be triggered if Obama and congressional leaders are unable to bridge partisan differences and strike a deal. They are part of the combination of tax increases and spending cuts dubbed the "fiscal cliff."

Medicare service providers would get hit with a 2 percent across-the-board cut, but Medicaid and subsidies for the uninsured under Obama's health care overhaul would be spared. The Medicare cut adds up to about $120 billion over ten years, with 40 percent falling on hospitals, according to Avalare's analysis. Nursing homes, Medicare Advantage plans and home health agencies also get hit.

The American Hospital Association says that would lead to the loss of hundreds of thousands of hospital jobs in a labor intensive industry that also generates employment for other businesses in local communities.

"It's very difficult to believe hospitals can absorb the kinds of numbers they are talking about without reducing service or workforce," said Kirby, the hospital association head. "You may decide that a service a hospital provides is not affordable ? for example, obstetrics in a rural community ? if you're making a little bit of money or losing a little bit of money by continuing to deliver babies in a rural community."

Independent analysts like Mendelson doubt that a 2 percent Medicare cut to hospitals would be catastrophic but say it will cost jobs somewhere.

Even if there is a budget deal, the squeeze will be on.

The administration has proposed $400 billion in health care cuts so far in the budget talks, coming mainly from Medicare spending. That's only a starting point as far as Republicans are concerned. They also want to pare back Medicaid and Obama's health care law and have also sought an increase in the eligibility age for Medicare.

Obama to meet congressional leaders on Friday: aide

WASHINGTON (Reuters) - President Barack Obama will host a meeting on Friday with the four top congressional leaders, a White House aide said on Thursday, as the president and lawmakers rush to break a deadlock over the so-called fiscal cliff days before a year-end deadline.

The president will meet with Senate Majority Leader Harry Reid, Senate Minority Leader Mitch McConnell, House of Representatives Speaker John Boehner and House Minority Leader Nancy Pelosi, White House spokeswoman Amy Brundage said.

Obama returned to Washington on Thursday after a truncated Hawaii vacation in an effort to restart stalled efforts aimed at averting tax increases and sharp spending cuts that economists say would push the economy into recession. The Senate also reconvened Thursday and the House of Representatives is due to go back into session on Sunday.

Navigating the Intersection of Legal Affairs & Communications ...

All communicators eventually face the challenge of dealing with legal issues, made increasingly complex by our 24/7 conversation involving multiple stakeholder groups. Fuelled by conventional wisdom and pop culture, many hold the opinion that lawyers are in an enterprise to manage risk down to zero, and communicators are there to promote the enterprise?s mission and vision to the exclusion of all else. That preconceived notion can result in an underlying tension between the two functions in good times, but when layered into a crisis situation, it can impede an organization?s response and derail its progress in returning to business as usual.

However, the two functions have a lot more in common than it may seem. Both are wholly focused on protecting the organization?s reputation: they just approach it from a different vantage point. While lawyers may cringe at their counterpart?s unrelenting use of adjectives, descriptors and praise for the organization, communicators become equally frustrated at the legal team?s use of redlining, striking what they perceive to be the best brand attributes out of the press release, web copy and social media posts.

Under the best of circumstances, this tension exists and can be the reason for the delay of marketing and communications output. Under the worst of circumstances ? for example, executive wrongdoing, product recalls, and labor strikes ? this tension can result in an impasse, with stakeholders eagerly waiting for the organization?s next message as social media posts pile up, camera crews stalk the doorway and the C-suite grows increasingly anxious.

To avert this danger and bridge this gap, the two organizations should begin by developing a thorough understanding of the other?s challenges and opportunities, work styles and overall mandate. Like any form of negotiation, the best way to reach the middle ground and forge an acceptable solution is to view the situation from the other party?s vantage point and to develop workable scenarios to be deployed in the event of a crisis.

Ultimately, a productive working relationship between a communications and a legal team is one long negotiation. Before you begin, lay the groundwork for a successful one.

First: Understand Where the Bias Comes From

Lawyers are not just being difficult. There is a reason why many lawyers are risk averse: they are trained to think that way, and paid to protect an organization whether in negotiating a contract, closing a deal, developing a litigation strategy or writing a settlement. It is an essential part of their training as law students and as young associates, and it is put to good practice as they develop their careers. This mindset saves companies a lot of money, time and potential exposure. In fact, the protection lawyers put in place for the enterprise can often be what save an organization from damage to its reputation.

In the throes of a crisis it can be maddening to see the messaging so carefully crafted be poked and prodded, examined from every angle and at times, diluted. However, it is a necessary activity. Consider the legal review an important checkpoint in a message development process that can often be infused with emotion and stress levels.

Not surprisingly, there is a reason we as communicators push the envelope: we know what does and does not make news. Reporters hang up on us. We see social media efforts fall flat because they don?t resonate with stakeholders and sound too ?corporate?. We often experience the legal protection as curtailing a healthy corporate dialogue.

However, this is all healthy tension. The best way to use it to your advantage is to acknowledge it exists, enjoy that it protects you and your organization from exposure, and build in a little extra review time if you think it may delay the crisis response.

Next: Know Your Organization and Share Your Mission

Know your organization?s business, and not just from the marketing and communications standpoint. Provide your team of communicators with greater visibility into legal and compliance issues that ultimately act on, influence, and shape your communications strategy. It can be tempting in proactive news cycles and feel-good marketing campaigns to ignore the legal and compliance issues that lurk beneath the surface. However, keeping someone on the communications team informed and engaged with that business function will pay dividends later. Whether you designate one person to be the point person for the legal department or every communicator folds this into his or her role, being aware of what could impact your communications strategy will allow your team to calibrate issues, responses, proactive campaigns accordingly throughout the year.

Similarly, educate your legal team by sharing your communications team?s goals. Demonstrate the value of positive, brand-building efforts over the year and how that supports sales, increases revenue and overall affects the organization?s productivity. Share your general programming for the year, be as specific as possible when launch dates will occur and why. This will ensure that the legal team can prepare for them, create workarounds, or share concerns if any.

Tips and Tactics for Better Working Relations Between Communications and Legal

If the two preceding activities have been in place for several months, when faced with a crisis your organization?s lawyers and communicators should be shoulder-to-shoulder at the table, designing workable solutions to the situation at hand. This foundation is essential for ensuring smooth functioning when the external environment becomes heated.

In addition to the relationship building efforts between the two departments, there are also tips and tactics that may help the process:

Develop a stakeholder map before a crisis hits. Always maintain a holistic view of the organization. It is not just about legal, and not just about the communications: when faced with a crisis it is about the entire reputation of the company and this includes many different and sometimes competing stakeholder groups. Consider developing a stakeholder map for your senior leaders in the organization, and show the impact certain communications have on different groups. This will allow your legal and compliance teams to see the big picture and develop collaborative solutions with you.

Identify ? hot-button? issues beforehand and share with any content creators. As you develop crisis communication plans, identify hot-button words, phrases, and messages. What words and issues are true deal breakers? What words and issues might have negative impact on certain stakeholder groups but not on others? Do some scenario-planning together and try to deal thorny and complex issues, such as multi-stakeholder communications, in less intense settings. Put the results in a cheat sheet, and circulate to both the Legal and Communications teams and any content creators. This will serve as an editing roadmap for the crisis and its immediate aftermath and reduce the back-and-forth editing of routine documents. Save the heavy editing session for the documents that matter the most.

Bring the legal team into your preparedness calls. Ideally, there is an early warning before a crisis hits. Allow a representative from the legal team to join your marketing and communications planning calls or meetings. This will allow Legal to identify red flags, allow Communications to ask questions and obtain guidance in real time, and streamline the materials development process.

Make it a real relationship ? not a series of time-consuming requests. The legal team is just as busy as you are. If it is a big enough crisis, they are also reviewing their own reports to legislators, regulators, and other entities. Establish a relationship with the department beforehand so if a crisis hits, they understand what you may be requesting. Offer to do a ?Communications 101? for the team and dissect a communications campaign from start to finish, showing where the legal and compliance insertion points are. Share your strategic communications calendar, and pinpoint where announcements are likely to fall during the year. Explain why the news release and social media response needs to be in tandem. Allow them to be a part of your process.

Build connections during down time. While it is in short supply in most organizations, take the quiet times as an opportunity to build the connections between your departments. Make it more personal than transactional. Have coffee and discuss what is happening in the organization. Share your views on how you each contribute to the business strategy. Discuss trends in your respective industries. It is a lot harder to lock horns with someone you know as a person.

Take time to learn their industry. Most communications people hunger for increased credibility and a seat at the table in an organization. The best way to do that is to become knowledgeable about the business and not just about what you do in it. Take time to learn about what the legal team actually does for the company. Knowing what a term sheet is can boost your credibility with transactional lawyers and just might make that next acquisition announcement flow more smoothly. Understanding a bit about the litigation process might give you more wiggle room with a litigation communications strategy. Realize that it isn?t always about the copy approval.

Comply with the legal team?s requests too. Is your company going through an audit? Is there a request for documents in litigation discovery? Remember, sometimes legal issues take priority in an organization. Be as prompt with your responses as you would want in return.

Realize you both are here to protect and enhance reputation? just from a different approach. And always, let cool heads prevail.
