APNewsBreak: Gas trade group seeks fracking probe

ALBANY, N.Y. (AP) ? A formal complaint filed with New York's lobbying board asks it to investigate whether Artists Against Fracking, a group that includes Yoko Ono and other A-List celebrities, is violating the state's lobbying law, according to the document obtained by The Associated Press.

The Independent Oil & Gas Association, an industry group that supports gas drilling, filed the complaint Tuesday with the state's Joint Commission on Public Ethics.

The complaint is based on an AP story that found that Artists Against Fracking and its members, including Ono, her son Sean Lennon, actors Mark Ruffalo and Robert De Niro and others, aren't registered as lobbyists and therefore didn't disclose their spending in opposition to hydraulic fracturing, or fracking, to remove gas from underground deposits.

"The public has been unable to learn how much money is being spent on this effort, what it is being spent on, and who is funding the effort," said Brad Gill, executive director of the Independent Oil & Gas Association of New York. "I understand the power of celebrity that this organization has brought to the public discussion over natural gas development, but I do not understand why this organization is not being required to follow the state's lobbying law."

The group confirmed it filed the complaint but didn't comment further.

Artists Against Fracking, formed by Ono and Lennon, says its activities are protected as free speech. The group was created last year amid the Cuomo administration's review to determine whether to allow hydraulic fracturing to remove gas from vast underground shale formations in southern and central New York.

Gov. Andrew Cuomo continues his review as public opinion has shifted from initial support based on the promise of jobs and tax revenue from drilling in economically depressed upstate New York to mixed feelings because of concerns over potential environmental and health effects.

Seven months after Artists Against Fracking was formed, the Quinnipiac University Polling Institute on March 20 found that New York voters were for the first time opposed to fracking, 46 percent to 39 percent.

"There's no doubt the celebrities had an effect," Quinnipiac pollster Maurice Carroll said. "As far as I can tell, they made all the difference."

A spokesman for Artists Against Fracking said the group and its individual members don't have to register as lobbyists.

"As private citizens, Yoko and Sean are not required to register as lobbyists when they use their own money to express an opinion and there's also no lobbying requirement when you are engaged in a public comment period by a state agency," spokesman David Fenton said.

"If the situation changes then, of course, Artists Against Fracking will consider registering," Fenton said. "Up to now, there has been no violation because they are entitled to do this as private citizens with their own money."

On its website, the group implores readers: "Tell Governor Cuomo: Don't Frack New York." Celebrities supporting the group have led rallies and performed in the song "Don't Frack My Mother," also carried on the Internet.

Ethics commission spokesman John Milgrim didn't immediately respond to a request for comment on Friday. By law, the commission doesn't confirm or deny pending investigations.

New York's former lobbying regulator, attorney David Grandeau, said he believed the group and the supporting artists, including musicians Paul McCartney and Lady Gaga and actress Anne Hathaway, should be registered and required to disclose details on their efforts to spur public opposition to gas drilling.

"When you are advocating for the passage or defeat of legislation or proposed legislation and spend more than $5,000, you are required to register," Grandeau said Friday. "Just because you are a celebrity doesn't mean that lobbing laws don't apply to you. Your celebrity status does not protect you in Albany."

Hip-hop mogul Russell Simmons and developer Donald Trump are among the high-profile figures who clashed with the commission when Grandeau was regulator. The biggest penalty for failure to follow the lobbying law resulted in a $250,000 fine against Trump and others over casinos in 2000.

1 of 4 reptiles stolen from Calif. museum found

FRESNO, Calif. (AP) ? A Central California science museum has recovered one of four reptiles that were taken by a burglar who was caught on surveillance video shoving the lizard and three snakes into a garbage bag.

The 3 1/2-foot savannah monitor lizard was back at Fresno's Discovery Center on Friday after it was found nearby, the Fresno Bee reported (http://bit.ly/YP2I8r ).

The suspect broke into the museum on Wednesday night or Thursday morning, smashed the tanks that held the four reptiles and made off with them. In addition to the lizard, the burglar took a 7-foot-long boa constrictor and two 3-foot-long ball pythons.

Surveillance video showed the suspect putting the four reptiles ? worth hundreds of dollars ? into a garbage bag. The suspect also went into the center's gift shop and stole children's toys, the phone system and the security monitor, the Bee reported.

The center's director, Mary Ellen Wright, said she was worried about the animals' conditions because they are mortal enemies.

"It would be like throwing two pit bulls in a locked room," she said.

Wright said the animals also could injure the thief. The monitor lizard has sharp, 2-inch claws.

Police are looking at the video, according to the Bee. A call to a Fresno police spokesman Friday was not immediately returned.

It wasn't immediately clear exactly where the monitor lizard was found, but a veterinarian is expected to examine the reptile to make sure it's OK.

Arkansas small business finance bill gets house backing - BuildMyBiz

An Arkansas state house subcommittee approved a measure that could help small businesses.

The New Market Jobs Act of 2013?was unanimously approved?and recommended to pass by?the House Economic Development Committee of Arkansas on March 20.?

The bill is aimed at promoting small business funding by giving investors an incentive to place money in main-street companies. The bill would allow the state to provide tax credits to investors that aid small firms with monetary contributions.

These credits may be allocated to partners or members of that company as well as transferred to other businesses. Also, the tax credits can be sold to insurance companies as long as the funds raised are used to invest in small business.

Additionally, the bill would provide tax cuts to any business that agrees to create jobs that pay 115 percent of the federal poverty level for a family of four.?

Adding that burden to the payroll for small business owners would hopefully be offset by the tax cut.?

The bipartisan bill was filed on March 7. It is sponsored by State Rep. Darrin Williams of Little Rock and State Sen. Jonathan Dismang of Searcy, both democrats. However, many of the state?s 68 co-sponsors are Republicans.

If passed, the small business legal change would be welcome news for main street business owners in the state.

Should I Reaffirm My Mortgage After Filing For Bankruptcy?

White House PictureAs a bankruptcy attorney, I get asked many questions each and every day about debt and mortgages. ? Should I reaffirm my mortgage after I file for bankruptcy???The answer is always ? NO. ?Now, this question has started coming in a different format? ?Clients who filed for bankruptcy protection years ago are asking: ?Why didn?t I sign a reaffirmation agreement? ?My mortgage company is telling me that you didn?t file the correct paperwork, and it goes on and on. ?This is where I usually have to take a few minutes to explain why I can give this advice without reservation.

Let?s start with what a reaffirmation agreement is and what it is not. ?My Colleague, Karen Oakes, answered this question in a prior post. ?Basically, the filing of a bankruptcy kills most contracts; including car purchases and home purchases. ?Once the contract is dead, the secured creditor may retrieve its collateral but cannot go after the debtor for any deficiency if the collateral was sold for less than what was owed. ?For example: ?let?s say you owed $10K on a car worth $5K at the time that you filed for bankruptcy protection. ?If you did not sign a reaffirmation agreement, you could surrender the car and pay nothing to the creditor. ?The creditor?s sole remedy was to retrieve their collateral. ?If you signed a reaffirmation agreement, you would breath life back into a dead contract, thereby giving your creditor additional rights under the contract. ?The most significant right or remedy available to the creditor was the ability to go after you for the additional money owed (in our example $5K).

Obviously, the same holds true for mortgage and promissory note on a home. ?If you fail to breathe life back into a dead mortgage and promissory note, the mortgage company is in a worse position than it would be had you signed a reaffirmation agreement. ?So, the mortgage companies want you to sign these agreements during your bankruptcy so that they maintain a superior advantage over you.

Recently, mortgage companies have been trying to coerce individuals into reaffirming debts on homes. ?The new trick is that they will no longer report to the credit reporting agencies that you are current on your monthly payments. ?The mortgage companies want homeowners to reaffirm mortgages that are sometimes 100K upside down.

Likewise, these same companies are telling individuals who filed bankruptcy in the past that they will not report all of the past monthly payments to the credit reporting agencies. ?So, several past clients have called with their concerns. ?Here is how you remedy the situation. ?First, you make all of your regular monthly mortgage payments post-bankruptcy. ?You keep track of when you sent the payment and when the money was withdrawn from your bank. ?This way, you have a current pay history. ?If you have filed bankruptcy in the past, you can always request a payment history from the lender.

Again, these agreements are in the best interest of the creditor, not the debtor. ?This is why it is so easy for me to advise clients not to sign them ?However, some clients are still concerned whether they will be able to keep their homes if they do not sign a reaffirmation agreement. ?In Florida the answer is yes. ?As long as you are current on your monthly payments, you can keep your home. ?I do not let my clients sign reaffirmation agreements on homes that are upside down.

If a client wants to sign a reaffirmation agreement on a home mortgage, they can do so, but I will not sign it.

Sharapova reaches Key Biscayne final for 5th time

KEY BISCAYNE, Fla. (AP) ? Maria Sharapova swept the first 10 points Thursday, then hardly let up from there. If she can keep it going for one more round, she'll finally have that elusive Sony Open title.

The four-time runner-up advanced to another Key Biscayne final by beating Jelena Jankovic 6-2, 6-1.

With a victory Saturday, the No. 3-seeded Sharapova would plug one of the few holes in her resume. She completed a career Grand Slam by winning the French Open last year but has never won the tournament near downtown Miami.

"It would mean so much to me," the Russian said. "I absolutely love this city. It's the first city I landed in when I came to the United States as a little girl."

Sharapova will face the winner of Thursday night's match between five-time champion Serena Williams and defending champ Agnieszka Radwanska.

Andy Murray, the 2009 champion and runner-up last year, advanced to the semifinals by beating No. 9 Marin Cilic 6-4, 6-3. Murray's opponent Friday night will be the winner of the match Thursday night between No. 4 Tomas Berdych and No. 8 Richard Gasquet.

No. 3 David Ferrer will play 34-year-old Tommy Haas in the other semifinal.

On a sunny, mild afternoon, Sharapova won seven consecutive games during one stretch against the No. 22-seeded Jankovic. Sharapova committed only 10 unforced errors from the baseline in 88 points while breaking serve six times.

Sharapova took the Indian Wells title two weeks ago and has won 22 consecutive sets, a career best, while winning 11 matches in a row. But she endured a sloppy quarterfinal against Sara Errani, winning despite 57 unforced errors, including 13 double-faults.

She double-faulted only three times against Jankovic and won 23 of 25 points on her first serve.

"I just really thought I needed to step it up from my last match and play a little better," she said. "I was really happy with the way I focused."

Jankovic, playing for the second time in less than 18 hours, was repeatedly a step late trying to reach Sharapova's shots.

"I wasn't moving," she said. "I felt heavy on the court. I felt really tired and exhausted."

Jankovic questioned scheduling that forced her to play in consecutive sessions while Williams and Radwanska had a day off before the semifinals.

"Kind of crazy," she said. "I had a couple of hours of sleep, and then I had to be back on the court."

Sharapova looked fresh even though she has played a lot of tennis lately. She's bidding to become the third woman to win Indian Wells and Key Biscayne in the same year.

Steffi Graf did it in 1994 and 1996, and Kim Clijsters won both in 2005.

"Winning a title on its own, whether it's here or Indian Wells, is a great achievement," Sharapova said. "To be able to come back from that and recover in just a few days and come back to the final here, it's great. Physically, many years ago I wouldn't be able to do that, so I'm very proud of the way I have recovered."

Sharapova has lost the Key Biscayne final to four different players ? Clijsters in 2005, Svetlana Kuznetsova in '06, Victoria Azarenka in '11 and Radwanska last year.

EBay sets aggressive 2015 target, shares climb

SAN FRANCISCO (Reuters) - EBay Inc aims to handle $110 billion of sales on its marketplace in 2015 by expanding globally and using mobile technology to lure more shoppers, an aggressive target that drove its shares 4 percent higher on Thursday.

The forecast by eBay Marketplaces chief Devin Wenig was higher than Wall Street had expected and represents a 47 percent jump in gross merchandise volume, or GMV, from 2012's $75 billion.

GMV is a closely watched measure of eBay's performance. Doug Anmuth, an analyst at JP Morgan, had predicted 2015 GMV of $101 billion.

After bleeding market share to Amazon.com Inc for years, Chief Executive John Donahoe began a turnaround effort in 2009 that set the Internet commerce company back on track by borrowing from its larger rival's playbook.

He took what was then a muddled auctions website and made it easier for shoppers to buy new items at fixed prices and get more free shipping and returns - essentially mimicking the Amazon experience. He also embraced mobile technology, creating shopping apps for smartphones and tablets that brought in new customers.

But eBay's online marketplace is still growing less than Amazon's and some analysts are concerned its growth may struggle to keep up with the overall expansion of the online retail sector.

On Thursday, eBay's Wenig told analysts and investors that the company's core business will deliver "at least" market rates of growth.

EBay's stock rose 4.1 percent to $54.20 in the afternoon.

"They are saying they have fixed the core marketplace, and they are now positioned to drive incremental growth from local, mobile and global initiatives," said Colin Sebastian, an analyst at R.W. Baird.

CEO Donahoe said that the company would enable $300 billion of commerce in 2015, up 71 percent from $175 billion in 2012.

That forecast includes sales on eBay's online marketplace, payments processed by PayPal and other transactions touched by the company's various businesses, such as GSI Commerce.

"That's one of the ways we will measure our success," Donahoe said during eBay's investor day at its headquarters in Silicon Valley.

To get this done, eBay is focusing on three main sources of potential growth - global expansion, local commerce and mobile applications that it hopes will encourage consumers to shop more on its marketplace and use PayPal more to pay for those purchases.

EBay is aiming to increase sales in emerging markets and BRIC countries - Brazil, Russia, India and China, by four times current levels in three years, Wendy Jones, an executive overseeing the global push, said.

By the end of 2015, as much as 25 percent of eBay active users and over 12 percent of global sales will come from BRIC countries and emerging markets, she added.

EBay's top executives will give other, new three-year financial forecasts later on Thursday.

Expectations run high on Wall Street. Anmuth of J.P. Morgan, is expecting revenue of $21.16 billion in 2015 and earnings of $3.98 per share that year, versus $14 billion and $2.36 a share in 2012.

The analyst is also calling for 2015 PayPal transaction volume of $246.9 billion that year.

The market for kosher products is surging ? driven by growing interest among non-Jews ? and with it interest in making kosher cooking more upscale.?

On the eve of Passover, which begins in Israel with tonight?s traditional seder meal, the?shuk?is jammed with everyone from hippie tourists to religious Jews with black hats and tight side curls. Amid the shouts of vendors and the swish of plastic bags, the ultra-Orthodox and ultra-modern jockey for everything from live fish to fresh garlic stalks to rich Israeli cheese and artisan breads. Nearly everything (except the bread) is labeled ?Kosher for Passover.?

?It?s the new and old noodling together. I love the feel of the past and the progression of the future,? says Yochanan Lambiase, a fifth-generation chef who fairly glides through the aisles of Machane Yehuda as he explores the magnificent palette with a small group of journalists. ?That?s very much Israeli society.??

While most of the shoppers here are Jewish, it?s no longer just Jews who are buying food grown and packaged in accordance with Jewish law, especially in North America.

Vegetarians, vegans, Hindus, Seventh-Day Adventists, and even Muslims have been increasingly choosing kosher products, driving a 64 percent growth in the US kosher market from 2003 to 2008, when it was estimated to be worth $12.5 billion. Since then the increase has been more gradual, but kosher foods remain one of the most steadily growing sectors of the expanding ethnic food market in North America, according to a March 2012 Agri-Trade Service report.?

?I feel the kosher food industry has reached a pinnacle, and now we have to move it into the 21st?century,? says chef Lambiase, who established the world?s first kosher culinary institute in the world here in Jerusalem in 2004 and is co-launching a new tour of the Mahane Yehuda market with?guide Cliff Churgin.

Mr. Lambiase sees himself as a pioneer of sorts. He was raised in a secular British home, and his kosher career was sparked by a love of cooking rather than of Jewish law, which forbids the consumption of pork and shellfish; requires that meat and dairy dishes be kept separate; and has strict rules governing the slaughter of animals.

But he quickly became drawn in by the religious aspects. ?Kosher isn?t anything to do with physical health, it has to do with spiritual health,? says Lambiase, who follows the Chabad-Lubavitch movement, a Hasidic branch of Judaism.?Today, he sees other newly observant Jews as playing a role in bringing kosher food to the gastronomic attention of the world.

?I think there?s been a huge revival in Jewish religiosity over the past 10 years and ? Jewish people normally know what good food is and they?re not going to take [their non-Jewish friends] out for gefilte fish.??

He heads back to his culinary institute, journalists in tow. We are more adept with our pens than with chef's knives, but he and fellow kosher chef Zev Beck are patient.

Despite the cilantro flying, tomatoes squirting on chef Beck?s jeans, and a stray garlic bulb rolling under the stainless-steel tables, after a couple of hours the rich aroma of fresh bread,?shakshoukas?(poached eggs in a spicy tomato base), and broiled eggplants garnished with homemade tahina wafts through the school.

If Lambiase and Mr. Beck can teach even journalists to be kosher cooks, their prospects for expanding the global ranks of kosher chefs look promising.

(AP) ? Nelson Mandela was back in the hospital for the third time in four months Thursday, and the 94-year-old former South African president was reported to be responding well to treatment for a chronic lung infection.

South Africa's presidency said that doctors were acting with extreme caution because of the advanced age of the anti-apartheid leader, who has become increasingly frail in recent years.

The Nobel Peace Prize laureate was admitted just before midnight to a hospital in Pretoria, the South African capital. He has been particularly vulnerable to respiratory problems since contracting tuberculosis during his 27-year imprisonment for fighting white racist rule in his country.

"The doctors advise that former President Nelson Mandela is responding positively to the treatment he is undergoing for a recurring lung infection," the presidency said in a statement. "He remains under treatment and observation in hospital."

Mandela, who became South Africa's first black president in 1994, is a revered figure in his homeland, which has named buildings and other places after him and uses his image on national bank notes.

"I'm so sorry. I'm sad," Obed Mokwana, a Johannesburg resident, said after hearing that Mandela was back in the hospital. "I just try to pray all the time. He must come very strong again."

In December, Mandela spent three weeks in a hospital in Pretoria, where he was treated for a lung infection and had a procedure to remove gallstones.

Earlier this month, he was hospitalized overnight for what authorities said was a successful scheduled medical test.

Presidential spokesman Mac Maharaj, referring to Mandela by his clan name "Madiba," said the latest stay was not for previously planned treatment.

"No, this wasn't scheduled. As you will appreciate the doctors do work with a great sense of caution when they are treating Madiba and take into account his age," he said. "And so when they found that this lung infection had reoccurred, they decided to have him immediately hospitalized so that he can receive the best treatment."

He said there had been a global outpouring of messages expressing concern for Mandela's health.

President Jacob Zuma wished Mandela a speedy recovery.

"We appeal to the people of South Africa and the world to pray for our beloved Madiba and his family and to keep them in their thoughts. We have full confidence in the medical team and know that they will do everything possible to ensure recovery," his office quoted him as saying.

In February 2012, Mandela spent a night in a hospital for minor diagnostic surgery to determine the cause of an abdominal complaint. In January 2011, he was admitted to a Johannesburg hospital for what officials initially described as tests but turned out to be an acute respiratory infection. He was discharged days later.

He also had surgery for an enlarged prostate gland in 1985.

The apartheid government released Mandela in 1990. Four years later, he became the nation's first democratically elected president under the banner of the African National Congress, helping to negotiate a relatively peaceful end to apartheid despite fears of much greater bloodshed. He served one five-year term as president before retiring.

Perceived successes during Mandela's tenure include the introduction of a constitution with robust protections for individual rights and the Truth and Reconciliation Commission, a panel that heard testimony about apartheid-era violations of human rights as a kind of national therapy session.

Mandela last made a public appearance on a major stage when South Africa hosted the 2010 World Cup soccer tournament.

Until his latest string of health problems, Mandela had spent more time in the rural village of Qunu in Eastern Cape province, where he grew up. He was visited there in August by then-U.S. Secretary of State Hillary Rodham Clinton.

Doctors said in December that he should remain at his home in Johannesburg to be close to medical facilities that can provide the care he needs.

Eritrean man sentenced to nine years for aiding Somali terrorist group

An Eritrean man who joined Somali guerrillas was sentenced Wednesday in New York City to more than nine years in prison for assisting a U.S.-designated terrorist group, federal authorities said.?

Mohamed Ibrahim Ahmed, 38, had been living in Sweden when he traveled to Somalia to join al-Shabaab militants in their war against the Somali government, according to court records.

The State Department has formally designated al-Shabaab as a foreign terrorist organization.


Ahmed was arrested in 2009 in Nigeria and sent to the U.S., where he pleaded guilty to one count of conspiracy to provide material support to a foreign terrorist organization and one count of conspiracy to receive military-type training from a foreign terrorist organization.?

Court records show that Ahmed's unexpected guilty plea came shortly before U.S. District Judge Kevin Castel was about to rule on his motion to suppress information he gave FBI officials while he was in custody in Nigeria.?

That motion had been seen as an important test of the Obama administration's contention that investigators can question terrorism suspects without reading them their Miranda rights against self-incrimination.?

The FBI revealed in case records unsealed this month that it interviewed Ahmed twice in Nigeria ? once without advising him of his rights and again after having done so.?

In a reply to Ahmed's motion to suppress, the government argued that it could legally question terrorism suspects without advising them of their rights and without compromising a criminal investigation if doing so was "relevant to the national security of the United States."

The second interrogation was conduced by different agents at a different location and was therefore "clean," it argued ? a contention that civil liberties advocates have questioned.

The judge's ruling on Ahmed's motion was never released.

Acer Predator AG3620-UR12


Plenty of mainstream PC makers have tried to get a foothold in the gaming market, to limited success. Dell bought their way into the gaming world by purchasing Alienware, and Asus has made strides with their Republic of Gamer's Line, but most major PC makers haven't done very well among the gaming crowd. Will the Acer Predator AG3620-UR12 be Acer's big break?

Design and Features
As designs go, the Predator is clearly made to appeal to gamers, with an orange on black chassis design that reflects a few elements of the Alienware X51 with the more vanilla looks of a mainstream system. HP tried to strike a similar balance with the HP Envy Phoenix h9-1320t, but the overall design still looked pretty generic?Acer's style has a little more flair, but it won't be turning many heads.

Acer also bundles in a wired keyboard and mouse, but you'll want to switch to something better. The mouse is a generic wired rodent, not made for gaming, but where it's just too basic, the keyboard is worse. Not only are the keyboard and mouse lacking any of the usual features gamers look for, like mechanical keys or programmable buttons, but they don't even offer a comfortable design. Instead, the keyboard uses a floating tile key design, similar to that seen on their laptops, but it's lousy as a gaming peripheral. Even brand new gamers would do well to pick up a different keyboard and mouse rather than dealing with these mediocre freebies.

The tower measures 16.5 by 7.1 by 17.2 inches (HWD), putting it in the same smallish category as the Maingear Potenza Super Stock, and the ultra-compact Digital Storm Bolt. The looks may not be too special, but Acer has gone out of its way to load up the Predator with plenty of features.

On the front side of the tower is an array of card readers (SD, MMC, miniSD, MS Pro/Duo, CF, xD), jacks for headphone and microphone, and four USB ports?two USB 2.0 and two USB 3.0. On the back of the tower are four more USB 2.0 and two more USB 3.0 ports, bringing the total to ten, so there are plenty of ports for connecting mice and other peripherals. Two PS/2 ports are available for older keyboards and joysticks, along with Gigabit Ethernet, and multiple video outputs (DVI, HDMI, and DisplayPort). There are also two antenna connections for 802.11n wireless (2.4 and 5.0GHz), with Bluetooth adding wireless connectivity for headsets and phones.

In the front of the tower are three hinged covers, which open to reveal three drive bays. One is already occupied by a 2TB hard drive (bolstered with a 16GB flash memory cache). The optical drive, a DVD-RW multi-drive with dual-layer support, can also be removed and replaced with even more storage, letting you store your entire games library in one place, while still leaving room for your digital media collection.

Open up the case and you'll find a 500W power supply and two available PCI-E slots. There's some room to work with in the chassis, but it doesn't have the carefully laid-out interior you might be used to from boutique vendors.

The 2TB hard drive offers plenty of storage space, but Acer does put a few extras on it in addition to Windows 8, making for a less than pristine out of the box experience. You'll probably want to remove trialware like Microsoft Office Starter 2010, and a 30-day trials of McAfee Internet Security Suite and Norton Online Backup. Acer covers the Predator with a one-year warranty.

Performance
Acer Predator AG3620-UR12 While it may not be made with upgrades and aesthetics in mind, the Acer Predator does have the goods where it counts?it's rocking a quad-core 3.4GHz Intel Core i7-3770, a whopping 32GB of RAM, and an AMD Radeon HD 8760 GPU with 2GB of dedicated memory.

These aren't the fastest top-of-the-line components, and this is clear in performance tests, where the Predator's 3,632 point PCMark7 score looks paltry next to the overclocked Maingear Potenza Super Stock (5,356 points) or the Falcon Northwest Tiki (5956 points), but it's still enough for impressive performance, as seen in Cinebench (7.47 points) and Handbrake (32 seconds).

Where the performance really comes into play is, of course, gaming. As before, we see that the Predator offers middle of the road performance, topping out in Heaven with 35 frames per second at full resolution and detail and only managing 25 fps in Alien vs. Predator. By comparison, both the Digital Storm Bolt (73 fps Heaven, 45 fps AvP) and the HP Phoenix h9 (57 fps Heaven, 59 fps AvP) better.

That said, even among these entry-level systems, the Acer Predator AG3620-UR12 offers passable performance at a relatively affordable price, coming in hundreds of dollars less. While this off-the-shelf system won't impress people with its looks or score you points with the overclocking crowd, you will still have a gaming rig that offers moderate performance for well under $1500, and that's no small feat. Acer might not make its bones among gamers with these sorts of cheap offerings, but it should catch the eyes of more than a few budget-conscious gamers.

(AP) ? A top NBC News executive said Wednesday the network is not considering replacing Matt Lauer as anchor of the "Today" show despite reports that Anderson Cooper of CNN was approached about the job.

"Matt Lauer is the best in the business," said Alex Wallace, NBC News executive who oversees the "Today" show. "We want him in the 'Today' show anchor chair for many years to come."

Wallace spoke after reports of a meeting with Cooper first appeared in Deadline Hollywood. The report was confirmed to The Associated Press by a source who spoke on condition of anonymity because the discussions were private and was not authorized to speak to the media.

The longtime king of morning television, "Today" has fallen behind ABC's "Good Morning America" in the ratings over the past year, particularly since the messy ouster of Ann Curry as Lauer's co-anchor last summer. There has been a flurry of stories recently retracing that decision. Lauer has said he urged the network to move more slowly with its planned changes, but a New York magazine cover story this week suggested he didn't like Curry and did little to help her.

Whatever happened, it's clear that many "Today" viewers who did not like what happened to Curry have taken their anger out on Lauer.

In 2012, Lauer's positive "Q'' score was 23 ? meaning 23 percent of people who knew him considered Lauer one of their favorite broadcasters, according to Marketing Evaluations Inc., a company that measures public sentiment toward well-known personalities. Last summer that score dropped to 14 and this month stands at 9, the company said. For the first time, George Stephanopoulos of "Good Morning America" has surpassed him. Among women, who make up the bulk of morning show audiences, Stephanopoulos is nearly twice as popular as Lauer and his "GMA" partner, Robin Roberts, is nearly three times as popular, the company said.

The approach to Cooper could mean that NBC has concluded that the time is right to actively work on replacing Lauer. Or not: his contract expires at the end of 2014 and it is widely assumed that Lauer will be ready then to move on from a job he's held since 1997. Under those circumstances, a forward-looking management team would be expected to be looking at alternatives.

"NBC News has many exploratory talks with talent inside and outside of the network, but to read anything specific into that is presumptuous," said an NBC News executive who spoke on condition of anonymity because the person was not allowed to discuss personnel moves.

Lauer has talked about resetting "Today" to be more serious, with less emphasis on crime stories. NBC was criticized this week by advocates for sexual abuse victims because "Today" aired excerpts of an interview that filmmaker John Ziegler had with convicted Penn State molester Jerry Sandusky; Lauer interviewed Ziegler on the air.

Potential internal replacements for Lauer could include Willie Geist, who co-hosts the third hour of "Today" in addition to work on MSNBC's "Morning Joe," and "Meet the Press" anchor David Gregory. Both have subbed for Lauer when he was absent.

The question for many in the television industry is whether the "Today" show can hope to change its fortunes with Lauer at the helm. "Today" hasn't beaten "Good Morning America" for any week in the ratings since the Olympics last summer and with Roberts' return after an illness in February, the gap between the two shows hit its widest. NBC says preliminary numbers show the two shows last week were as close as they've been since December and that "Today" frequently wins among youthful news viewers.

"This awful, false narrative campaign against Matt has certainly made him vulnerable, but Matt is still, in my opinion, the best anchor who has ever occupied that chair," said Shelley Ross, former executive producer at "Good Morning America" and "The Early Show" at CBS, where she competed against Lauer. She said she believed NBC's competitors were helping to keep negative stories about Lauer alive.

NBC was right to replace Curry but handled it badly, she said.

The cyclical nature of television is also likely hurting Lauer. It's a rare personality that stays beloved forever. Ross and others in the industry believe that Lauer's latest contract, which reportedly pays him $25 million a year, drove a wedge between the anchor and viewers who no longer view him as a regular guy.

Paul Friedman, a former news executive at ABC and CBS, also said Lauer is the best he's seen in his role. But currently, ABC's "Good Morning America" is a broadcast that provides viewers with information from personalities who appear to be enjoying what they're doing, he said.

"I don't think the fuss in the press is what matters to viewers," said Friedman, who teaches journalism at Connecticut's Quinnipiac University. "What matters is what is seen on the air, and right now what's on the air is a cast that doesn't appear to enjoy themselves and what they're doing ? as they do at 'Good Morning America.'"

Personal Health: What Causes Hearing Loss

Noise, not age is the leading cause of hearing loss. Unless you take steps now to protect to your ears, sooner or later many of you ? and your children ? will have difficulty understanding even ordinary speech.

Tens of millions of Americans, including 12 percent to 15 percent of school-age children, already have permanent hearing loss caused by the everyday noise that we take for granted as a fact of life.

?The sad truth is that many of us are responsible for our own hearing loss,? writes Katherine Bouton in her new book, ?Shouting Won?t Help: Why I ? and 50 Million Other Americans ? Can?t Hear You.? The cause, she explains, is ?the noise we blithely subject ourselves to day after day.?

While there are myriad regulations to protect people who work in noisy environments, there are relatively few governing repeated exposure to noise outside the workplace: portable music devices, rock concerts, hair dryers, sirens, lawn mowers, leaf blowers, vacuum cleaners, car alarms and countless other sources.

We live in a noisy world, and every year it seems to get noisier. Ms. Bouton notes that the noise level inside Allen Fieldhouse at the University of Kansas often exceeds that of a chain saw.

After poor service, noise is the second leading complaint about restaurants. Proprietors believe that people spend more on food and drink in bustling eateries, and many have created new venues or retrofitted old ones to maximize sound levels.

When I?m told about a new restaurant, my first question is, ?Is it noisy?? My friends and I will never return to one in which the racket makes it impossible to converse with tablemates. Perhaps the young diners the restaurateurs covet ?talk? by texting.

The ears are fragile instruments. When sound waves enter the ear, they cause the eardrum to vibrate. The vibrations are transmitted to the cochlea, in the inner ear, where fluid carries them to neatly organized rows of hair cells. These in turn stimulate auditory nerve fibers, each attuned to a different frequency. These impulses travel via the auditory nerve to the brain, where they are interpreted as, say, words, music or an approaching vehicle.

Damage to this delicate apparatus results from both volume and length of exposure to sound. Very loud noises, or chronic exposure to sound even when it is not particularly loud, can wreak havoc on hair cells, causing them to become disarranged and to degenerate.

We are born with a fixed number of hair cells; once they are dead, they cannot be replaced, and auditory sensitivity is permanently lost. Usually, sensitivity to high-frequency sounds is first to go, followed by an inability to hear the frequencies of speech.

Furthermore, the effects of noise exposure are cumulative, as Robert V. Harrison, an auditory specialist at the University of Toronto, noted recently in The International Journal of Pediatrics. Although we start out with a redundancy of hair cells, with repeated noisy insults, enough are destroyed to impair hearing. Thus, damage to hair cells incurred early in life, as has happened to many rock musicians and rock concert aficionados, can show up in midlife as difficulty understanding speech.

Sound volume is measured in decibels (dB), and the level at which noise can cause permanent hearing loss begins at about 85 dB, typical of a hair dryer, food processor or kitchen blender.

Dr. Michael D. Seidman, the director of otolaryngology at Henry Ford West Bloomfield Hospital in Michigan, told me to use ear plugs when I dry my hair or mow my lawn with a gas-powered mower, and to cover my ears when an emergency vehicle passes with siren blasting. Ear protection is a must for people who shoot guns as well as those who ride motorcycles or use snow blowers, leaf blowers, hand or pneumatic drills or chain saws.

But even noisier than many of these is the maximum output of some portable music players, which can exceed occupational safety levels and produce sound levels in the ear on a par with that of a jet taking off. If you listen to music with earbuds or headphones at levels that block out normal discourse, you are in effect dealing lethal blows to the hair cells in your ears, Dr. Seidman said.

A national study in 2006 by the American Speech-Language-Hearing Association found that among users of portable music devices, 35 percent of adults and up to 59 percent of teenagers reported listening at loud volumes.

Dr. Harrison urges purchasers of such ?personal entertainment devices? to read and heed the warnings and practical advice on package inserts. Too often people turn up the volume to overcome surrounding noise. A better plan is to set a maximum volume while in a quiet environment and never go above that.

In general, if other people can hear what you?re listening to, the volume is turned up too high. Many times I?ve had to change my seat on the subway or bus because the rider next to me was using a music player as if it were a boombox.

Some portable listening devices come with the ability to set a maximum volume, which may be worth the added cost to parents concerned about protecting their children?s ears.

At a given volume level, earbuds deliver higher noise levels than over-the-ear headphones. If earbuds are used, Dr. Harrison suggests selecting ones that fit loosely and never inserting them tightly into the ear canal. Alternatively, when you are alone and not at risk of missing important environmental cues, like an approaching vehicle, consider using noise-canceling over-the-ear headphones that block out background noise and enable you to listen at a lower volume.

Even toys meant for young children can generate ear-damaging levels of noise. The American Speech-Language-Hearing Association lists as potential hazards cap guns, talking dolls, vehicles with horns and sirens, walkie-talkies, rubber squeaky toys, musical instruments and toys with cranks. According to the association, some toy sirens and squeaky rubber toys can emit sounds of 90 dB, as loud as a lawn mower.

It suggests that parents with normal hearing test new toys before giving them to a child. ?If the toy sounds loud, don?t buy it,? is the recommendation. For noisy toys already bought, consider removing the batteries or taping over the speaker.

Major oil companies testify on oil tax change

JUNEAU, Alaska (AP) -- A proposed overhaul of Alaska's oil tax structure would be a vast improvement over the existing system, but it doesn't go far enough, industry representatives told the House Resources Committee on Tuesday.

Dan Seckers, tax counsel for Exxon Mobil Corp., said SB21 would make Alaska more competitive ? a point that's been underscored by consultants to the Legislature and Gov. Sean Parnell's administration ? and it should lead to more investment. But he said he "would love" for Alaska to become even more attractive.

The committee is working on SB21, which is aimed at making Alaska more competitive for investment dollars and increasing oil production. The North Slope's major players ? BP PLC, ConocoPhillips and Exxon Mobil ? were asked to testify Tuesday evening. The committee planned to hear from smaller producers and explorers Wednesday.

Committee co-chair Eric Feige has said he hopes to advance a bill sometime next week. The bill would then go to the House Finance Committee. The Legislature is scheduled to adjourn April 14.

Alaska's existing oil tax structure, passed in 2007, features a 25 percent base tax rate and a progressive surcharge that's triggered when a company's production tax value hits $30 a barrel. The idea when it passed was that the state would help companies on the front end with things like tax credits and share profits on the back end when oil flowed and prices were high.

Companies have said the surcharge ? credited with helping fatten state coffers in recent years ? eats too deeply into their profits when prices are high, discouraging new investment. Alaska's revenue commissioner has said he's seen no evidence that tax credits to oil companies ? which could top $1 billion next year ? have led to increased production.

SB21, which narrowly passed the Senate last week, would eliminate the surcharge and revamp the suite of tax credits with a goal of focusing incentives on production. The latest version of the bill would raise the base tax rate to 35 percent, provide a $5 credit for each taxable barrel of oil produced and provide a 20 percent tax break, known as a gross revenue exclusion, for oil from new fields and new oil from legacy fields, long the mainstays of Alaska's oil industry.

Seckers and representatives of ConocoPhillips said the bill is an improvement over what is now in place. But they said the tax rate under SB21 is too high and they wanted greater clarity on what oil would qualify for the gross revenue exclusion. Seckers also questioned whether a $5-per-barrel allowance was enough to balance other provisions of the bill, like the base tax rate.

Bob Heinrich, vice president of finance for ConocoPhillips Alaska, said the proposal would represent a tax increase at lower oil prices. Given Alaska's high-cost environment, he said the bill doesn't go far enough toward improving Alaska's competitiveness.

T-Mobile USA eyes growth from iPhone, marketing changes

NEW YORK (Reuters) - T-Mobile USA said on Tuesday that it will start selling Apple Inc's iPhone on April 12, making it the last of the big national U.S. operators to sell the popular smartphone.

The No. 4 U.S. mobile provider, which is seeking to merge with smaller rival MetroPCS Communications, is hoping the device can help stem customer losses. The launch follows a marketing overhaul that eliminates device subsidies and two-year service contracts favored by its bigger rivals.

T-Mobile, a unit of Deutsche Telekom AG, hopes its new approach will differentiate it from bigger rivals that already sell the iPhone: Sprint Nextel, AT&T Inc and Verizon Wireless, a venture of Verizon Communications and Vodafone Group Plc.

The company, which struggles with customer defections, hopes to attract cost-conscious consumers through an aggressive marketing campaign that focuses on its lack of service contracts and clearly outlines the monthly cost to consumers to own devices such as the iPhone.

U.S. operators have traditionally subsidized phones in exchange for tying customers into contracts but do not disclose how much of their monthly charges covers the device, a practice that T-Mobile USA criticized as lacking transparency.

"The industry's broken," T-Mobile Chief Executive John Legere said at a press event to announce the iPhone launch and discuss the service plans, which he promised late last year.

In particular, T-Mobile USA is taking aim at No. 2 U.S. operator AT&T because the two companies use the same network technology, making it easier for consumers to bring their AT&T phones to T-Mobile's network.

Legere estimated that T-Mobile customers would pay about $1,000 less over two years than they would for roughly comparable services at AT&T. T-Mobile's website also directly compares its pricing to AT&T's service fees.

However, AT&T appeared unfazed by the campaign. Spokesman Mark Siegel's response was: "Whatever."

Legere said that the iPhone and the new marketing plans will help the company stem its losses of bill-paying customers this year and create growth in this segment in 2014. The company, which ended 2012 with 33.4 million customers, lost 515,000 contract customers in the fourth quarter.

"You'll see discernable progress each quarter," the executive told Reuters, promising significant improvement in first quarter from the fourth quarter and second quarter numbers that are significantly better than the first quarter.

T-Mobile will offer the iPhone 5, Apple's latest model, for an upfront payment of $99.99 followed by 24 monthly payments of $20, adding up to $580 over two years. Its rivals charge $200 upfront to customers who sign a two-year contract, but customers who do not sign a contract pay about $650.

Slight differences in operators' service plans make comparison of total costs for consumers difficult, but analysts said that T-Mobile's offer does appear to be cheaper than those of its bigger rivals.

Reticle Research analyst Ross Rubin said it was still unclear whether consumers have as much disdain for contracts as T-Mobile hopes. But he said consumers will likely find the lower upfront cost for phones attractive and that the addition of the iPhone should help T-Mobile retain customers.

"Not having the iPhone 5 was certainly a big hole in its portfolio," Rubin said.

T-Mobile said it will sell the older iPhone 4 for a $69 up-front payment and a commitment to pay $20 a month for two years. It also promised smaller upfront fees for the latest smartphones from BlackBerry and HTC Corp.

Bigger rivals AT&T and Verizon have said they would closely watch T-Mobile's new service model and that they could follow suit if it proves popular with consumers.

Andrew Sherrard, T-Mobile's senior vice president of marketing, said the company would significantly increase its marketing spending, but he declined to give details.

T-Mobile also said on Tuesday that it had upgraded its network with faster data services in seven markets using the Long Term Evolution (LTE) technology that its bigger rivals have a head start in delivering.

T-Mobile promised to offer LTE in markets with a population of 100 million by mid-year and expects to broaden coverage to 200 million by year end.

One key element of Legere's strategy involves the proposed merger with MetroPCS, which needs shareholder approval at a special meeting on April 12, the date of T-Mobile's iPhone launch.

Two large activist shareholders, Paulson & Co Inc and P. Schoenfeld Asset Management, are campaigning to block the deal due to the level of debt that the combined company will have on its books. But Legere insisted the merger would go through.

"It will be approved despite ... several greedy hedge funds that are trying to take a double-dip out of that process," Legere said.

Court turns away class action against Comcast

WASHINGTON (AP) ? The Supreme Court is turning away a class action lawsuit against cable provider Comcast Corp.

The high court on Wednesday overturned a lower court decision to certify as a class customers who say the company's monopoly in parts of the Philadelphia area allowed it to raise prices unfairly.

Justice Antonin Scalia said in a 5-4 decision the customers need to be able to prove more of their case early in the process, including whether damages can be calculated for the entire group. The Comcast subscribers had argued that doing so would lead to even more limits on class actions.

Justices Stephen Breyer and Ruth Bader Ginsburg wrote the dissent jointly for themselves, Sonia Sotomayor and Elena Kagan.

In an unusual move, Breyer and Ginsburg read parts aloud in the courtroom.

As U.S. natural gas prices flirt with the $4 mark, some skeptics of the so-called shale gas revolution think prices are headed much higher. Such a move would, not surprisingly, seriously undermine the official story that the United States has a century of cheap natural gas waiting for the drillbit.

Several years ago when natural gas began flowing in great quantities from deep shale deposits beneath American soil, it seemed to be the beginning of the end of America?s troubled journey into dependence on energy imports?a journey marked by frequent worry, occasional war and enormous expense.

And that, say those closest to the action, risks tainting air, land, and drinking water and compromising the health of humans and animals alike.

Well, at least we can say that shale gas is plentiful, cheap, American, and much easier on the climate than coal or oil. It didn?t take too long before people started looking into whether shale gas really was that much easier on the climate.?A Cornell University researcher came to the conclusion that shale gas was probably worse for climate change than coal. His conclusion hinged in part on what are called ?fugitive emissions??unintentional, but unavoidable releases of unburned methane into the atmosphere during the?hydraulic fracturingoperations performed to extract the gas. Methane is?some 20 times more potent?than carbon dioxide as a greenhouse gas.?

How iPhone App Switching Should Work - Business Insider

Apple's iPhone operating system, iOS, is starting to feel stale. It's pretty much looked the same since the smartphone debuted back in 2007.

Jesse Head, a designer and developer, has dreamed up this beautiful but functional concept that re-imagines the entire iOS multitasking experience.?

While Apple has made slight changes to the experience nothing has been as drastic as this concept from Head. We first spotted the video over at Gizmodo.

Keep in mind there's very little chance Apple will enable features like this on the iPhone any time soon. The latest reports suggest the next version of iOS will have a few design tweaks, but won't be a radical overhaul of the operating system.

Plus, it's likely this kind of app multitasking would destroy your iPhone's battery life, something Apple wouldn't want to do.

TSX drops to near one-month low after Cyprus deal

TORONTO (Reuters) - Canada's main stock index fell to its lowest point in nearly a month on Monday as investors reconsidered their initial relief over a bailout deal for Cyprus, while shares of BlackBerry dropped 4.5 percent after a downgrade by Goldman Sachs.

Stocks initially rose after Cyprus reached a deal with international lenders for a 10 billion euro ($13 billion) bailout, averting a collapse of its banking system.

But sentiment quickly soured on concerns the terms of the deal - which will inflict heavy losses on uninsured depositors - could be applied in resolving other euro zone banking problem.

Economically-sensitive resource stocks were hit hardest in spite of mixed commodity prices, but the selling was also broadly based, with all 10 TSX subgroups retreating.

"Obviously the problems in Europe are not over. We're not seeing a resolution to it anytime soon," said Arthur Salzer, executive director and chief executive officer of Northland Wealth Management.

The heavily weighted energy sector dropped 0.76 percent, extending its recent drop from four-month highs hit last week. Oil prices edged higher on Monday, but have steadily weakened since mid-February.

Talisman Energy fell 1.4 percent to C$12.15, while AltaGas Ltd retreated 3.2 percent to C$34.90 after the energy infrastructure company said it would buy U.S. power company Blythe Energy LLC.

Among individual movers, BlackBerry fell 4.5 percent to C$14.51, building on its 8 percent drop on Friday following a disappointing U.S. launch for its new Z10 smartphone.

Goldman Sachs downgraded the company's shares on Monday, citing concerns over "a lack of marketing support and poor positioning for the product.

All told, the S&P/TSX composite index <.gsptse> fell 76.64 points, or 0.6 percent, to finish at 12.680.71, hitting its lowest level since Feb 27.

The materials sector fell 1.44 percent, led by gold stocks, as the price of the precious metal slumped as investor appetite for safe haven assets fell sharply after the Cyprus deal.

Yamana Gold fell 3.3 percent to C$15.47, while Kinross Gold dropped 3.4 percent to C$8.04.

"Gold is probably going to consolidate further before going higher," said Salzer.

Base metals miners were also on the defensive, as copper miner First Quantum Minerals retreated 3.5 percent to C$19.41 and Thompson Creek Metals fell 3.7 percent to C$3.11.

Financial stocks eased 0.26 percent, led by life insurers Manulife Financial , which sank 1.6 percent to C$14.97, and Sun Life Financial , which dropped 1.6 percent to C$27.53.
